We understand that disputes that are close to home have a particularly wearing effect on the parties. We have extensive experience of many kinds of boundary and neighbour disputes from rights of way and planning to nuisance and antisocial behaviour. The flexibility of mediation allows us to incorporate site visits into the process to fully understand the issues involved.
We are sensitive to the different complexities that arise from agricultural, commercial and residential land and property disputes and have a good understanding of the requirements for both registered and unregistered land as well as the rights and responsibilities in commercial leases and residential tenancy agreements.
Valuation and reporting on property defects for purchase and insurance claims is a separate area that leads to disputes – most frequently in the form of professional negligence claims against the surveyor responsible for the report.
Mediating these disputes can lead to resolution of a claim that is otherwise adding layers of stress to a problem with a property sale or repair of a defect, and can allow costs that would otherwise be spent on litigation to be applied to remedying the problem with the property.
